What Constitutes Underage Drunk Driving?

While someone who is 21 or older can have a blood alcohol content (BAC) of up to .08 percent while driving, drivers under 21 are considered impaired if they have a BAC of .02 percent or higher.

The penalties for an underage consumption charge are also harsh. If the driver has a BAC between .02 percent and .08 percent, he or she could face up to 30 days in jail and an expensive fine. If a driver's BAC is more than .08 percent, he or she will face spending 10 days to one year in jail, license suspension and a fine of up to $1,000.
